The overall purpose of the role
The Complaince and Governance Specialist will be responsible for the monitoring of controls to prevent exposure to compliance risks, monitor Fit & Proper requirements of Employees, liaise between management and Compliance and provide required information to the Compliance
team. Manage and mitigate compliance risks within business including involvement of management. In addition, this role requires
the monitoring and performing of regular compliance- and risk control checks on business processes. The Compliance and Governance Specialist will be required to implement processes to comply with regulations provide training to employees where required.
Key responsibilities
• Implementation and monitoring of business processes to ensure compliance with all regulatory requirements e.g. POPIA
and FICA Party Due Diligence process and reports.
• Provide compliance and risk management reports on request e.g. Fit & Proper status including progress with qualifications,
accreditations, CPD points, Representative Registers, Supervision Reports, Conflict of Interest Registers, etc.
• Identify compliance risks and incidents, advise Compliance team thereof and improving compliance awareness
• Provide appropriate input on projects where required
• Provide guidance and training and ensure employees are aware of legislative changes and changes in business processes e.g. POPIA
• Monitoring of processes and regularly perform checks to measure compliance and control effectiveness and address gaps
• Updating of the Third Party / Outsource Registers and management of Third Party / Outsourcing arrangements
• Implement measures to ensure compliance with applicable retention and other policies
• Monitoring of and reporting on complaints process
• Liaise with Legal, Risk and Compliance with regard to risk management, reporting and advice
• Staying informed on applicable legislation
• General administrative duties
Qualification and Experience
• Legal- or Commerce Degree or at least NQF5 qualification recognized by the FSCA
• Regulatory Examinations – RE5 and RE1
• Continuous adherence to the Fit & Proper requirements
• Minimum of 3 – 5 years’ experience in compliance monitoring.
• Knowledge of the financial services industry and legislation (e.g. FAIS, FICA, POPIA)
• 1 year management experience
• Valid driving license
Knowledge and Skills
• In-depth knowledge of the FAIS Act and information in the regulatory framework
• Extensive knowledge of legislation, regulations, and legal principles applicable to the financial services industry, in particular the healthcare industry
• Ability to interpret and apply legislation, perform monitoring, identify risks, provide regulatory guidance
• Development, implementation of requirements in processes and monitoring of processes
• Assertive
• Excellent communication skills (both written and verbal – English and Afrikaans)
